To make the process cost-effective for our clients, we offer predictable and value-added fee arrangements such as flat fees, contingency fees, and hybrid flat-fee/contingent arrangements. Under some circumstances, we can collect our fees from the debtor in addition to the amount owed to our client.
Collections Without Court Action
Simply opening a dialogue with a debtor on behalf of our client often yields results. A demand letter or personal telephone call from our law firm is often more effective than other collection services, as the debtor comes to understand the seriousness of the matter and the remedies that we may pursue on behalf of our client. We advise our clients when we believe a payment plan, mediation or arbitration may be effective for collecting the debt, or when foreclosure or repossession are appropriate.
When payment demands and dispute resolution efforts are not successful, collection may require filing a lawsuit. We work within the law in judicial collection actions, including the Texas Finance Code, the Texas Deceptive Trade Practices Consumer Protection Act (DTPA), the Texas Uniform Enforcement of Foreign Judgments Act (UEFJA), the Texas Fair Debt Collection Practices Act (FDCPA), and the federal Fair Credit Reporting Act (FCRA).
